1. About these Terms
These Terms of Service (“Terms”) govern your access to and use of locu.nz (the “Platform”), operated by Locu NZ Limited(“locu.nz”, “we”, “us”), a New Zealand-based two-sided marketplace that connects healthcare locums (“Locums”) with clinics, pharmacies and other healthcare businesses (“Businesses”) seeking shift coverage. By creating an account or using the Platform you agree to these Terms.
2. Eligibility
You must be at least 18 years old and legally entitled to work in New Zealand in your nominated role. Locums must hold current registration with the relevant professional council (NCNZ, MCNZ, PBNZ, etc.) and a valid Annual Practising Certificate (where applicable) for the duration of any shift booked through the Platform. Businesses must be lawfully operating healthcare services in New Zealand.
3. The Platform’s role
locu.nz is a technology platform that facilitates the introduction, booking, check-in/check-out and invoicing for locum shifts. We are not the employer of any Locum and not a party to the engagement between a Locum and a Business. The Locum is engaged as an independent contractor of the Business unless the parties expressly agree otherwise.
4. Accounts & verification
You are responsible for the accuracy of the information you submit, including registration numbers, APC details, police-vet status, indemnity insurance and right-to-work declarations. We may verify, suspend or remove accounts that appear inaccurate, fraudulent, or non-compliant with professional council requirements. You must keep your login credentials secure and notify us promptly of any unauthorised use.
5. Shifts, applications & cancellations
- Businesses post shifts with a stated rate, location and role requirements.
- Locums apply only to shifts matching their professional council’s scope.
- Once a Business accepts an application, a binding engagement is formed between the Locum and the Business.
- Cancellations by either party within 24 hours of the shift start time may result in a cancellation fee or platform-imposed restrictions, except where cancellation is due to genuine illness, family emergency, or reasons outside the cancelling party’s reasonable control.
6. Check-in, timesheets & PIN verification
Worked time is recorded through the Platform’s PIN-based check-in and check-out flow. The PIN-confirmed times constitute the agreed timesheet for invoicing purposes. Disputes must be raised within 7 days of the shift end.
7. Fees & payments
- locu.nz charges a platform fee on the gross value of every filled shift. The current rate is disclosed to Businesses during signup and may change from time to time on notice as set out in clause 12.
- Businesses are invoiced post-shift and pay each invoice by its due date using the payment instructions issued with it.
- Locums are paid the agreed rate less the platform fee and any statutory withholdings, ordinarily within the standard payout cycle of the chosen payments provider.
- GST applies where required by NZ tax law. You are responsible for your own income tax, ACC levies, and any other statutory obligations.
8. Conduct & professional obligations
You must comply with all applicable NZ laws, professional council standards, the Health and Disability Commissioner’s Code of Rights, the Health Practitioners Competence Assurance Act 2003, the Children’s Act 2014 (where applicable), and any reasonable Business policies advised before the shift. We may suspend or remove users who breach these obligations.
9. Intellectual property
The Platform, its branding, content and code are owned by or licensed to locu.nz. You receive a limited, revocable, non-transferable licence to use the Platform for its intended purpose. You may not scrape, reverse engineer, or resell the Platform or its data.
10. Liability
To the maximum extent permitted by law, locu.nz is not liable for any indirect or consequential loss arising out of your use of the Platform, the conduct of another user, or the outcome of any shift. Nothing in these Terms limits any rights you have under the Consumer Guarantees Act 1993 where you are dealing as a consumer. Our aggregate liability for any matter is capped at the platform fees paid by you in the 12 months preceding the claim.
11. Termination
You may close your account at any time. We may suspend or terminate access for breach of these Terms, regulatory non-compliance, or where required by law. Provisions that by their nature survive termination (fees owing, liability, indemnities, dispute resolution) continue to apply.
12. Changes
We may update these Terms from time to time. Material changes will be notified by email or in-app at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance.
13. Governing law
These Terms are governed by New Zealand law and the parties submit to the exclusive jurisdiction of the New Zealand courts.
